Terms of Service

These Terms of Service govern your access to and use of Sayspoke.
By creating an account or using Sayspoke, you agree to these Terms and acknowledge our Privacy Policy and Cookie Policy.
Sayspoke is currently in open beta. The product may change, experience downtime, lose features, or behave unexpectedly. Use the beta with that understanding.
1. What Sayspoke is
Sayspoke is built around personal Moments, public Finds, Communities, and Backing Tags.
Users may be able to:
- Create a normal personal Sayspoke profile
- Send and approve mutual Add requests
- Share personal Moments with mutual Adds
- Create and manage a separate Finds creator profile
- Publish public Finds
- Follow Finds creator profiles through one-way creator subscriptions
- Join and participate in Communities
- Upload photos or videos
- Back visible content with Backing Tags
- Leave Notes or replies where the relevant access rules allow it
- Save content
- Send private messages
- Report content or users
- Use privacy, account, safety, moderation, and trust controls
Sayspoke may add, remove, limit, or change features over time.
2. Product relationships and content surfaces
Sayspoke has separate personal, creator, and Community systems.
Normal profiles and Adds
A normal Sayspoke profile represents a person’s personal identity.
An Add is an approved, mutual connection between two normal profiles.
Sending an Add request does not create a connection. When the recipient approves the request, both profiles become connected.
Users may disable incoming Add requests. An Add may be removed or overridden by blocking.
Moments
Outside Communities, Moments are personal posts visible only to the person who posted them and their current mutual Adds.
Personal Moments are not publicly discoverable and do not participate in public Find recommendations or advertising.
A recipient may still copy, photograph, record, or redistribute content they can view. Do not share a Moment unless you trust the people who can access it.
Finds creator profiles and follows
A Finds creator profile is a separate public publishing identity.
Following a Finds creator profile is a one-way subscription to that creator’s public Finds.
Following a creator does not:
- Create a personal Add
- Reveal the creator’s personal Moments
- Provide access to the creator’s Add relationships
- Automatically connect the users’ normal profiles
Adding someone through a normal profile does not automatically follow their Finds creator profile.
Finds
Global Finds are public creator posts intended for public feeds, discovery, recommendations, search-like surfaces, creator profiles, Backing Tag collections, sharing, advertising, and eligible creator monetization.
Communities
Communities are the only Sayspoke surface where Moments and Finds may appear together for people who are not mutual Adds.
Community content is governed by the Community’s:
- Visibility
- Membership rules
- Posting permissions
- Approval requirements
- Moderation rules
A Community Moment does not become a globally discoverable Moment.
A Find posted specifically to a Community does not automatically become a global Find unless Sayspoke provides and the creator uses a separate global-publication action.
3. Eligibility
You must be at least 16 years old to create an account or use Sayspoke.
If you are under the age of majority where you live, you may use Sayspoke only if:
- Your parent or legal guardian permits it where required
- You are allowed to use Sayspoke under applicable law
- You satisfy any higher minimum age that applies where you live
Some countries, states, provinces, or regions may require a higher minimum age, parental or guardian consent, age verification, age assurance, or other protections.
You may not use Sayspoke if:
- You are under 16
- You do not meet the minimum age required where you live
- You are required to have parent or guardian permission and do not have it
- You provide false age, date-of-birth, location, or eligibility information
- You are legally prohibited from using the service
- We previously banned your account and have not authorized your return
- You are using Sayspoke to violate law, harm others, or evade enforcement
We may suspend, restrict, or remove an account if we reasonably believe the user does not meet Sayspoke’s eligibility requirements.
4. Open-beta access
Sayspoke is currently in open beta. Eligible users may create an account without an invite code.
Open-beta access does not guarantee:
- Permanent access
- Continued availability of any feature
- Compensation
- Future public-launch access
- Creator or monetization eligibility
- Verification
- Any special status or rights
We may pause or limit signups, change beta eligibility, restrict features, or remove access when reasonably necessary for safety, security, legal, operational, or product reasons.
5. Your account
You are responsible for your account and activity conducted through it.
You agree to:
- Provide accurate account information
- Provide accurate age and eligibility information
- Keep your login credentials secure
- Not share your password
- Notify us if you believe your account has been compromised
- Not impersonate another person or organization
- Not create accounts to evade blocks, bans, rate limits, age rules, or enforcement
- Not allow another person to use your account in a way that violates these Terms
We may suspend, restrict, or remove accounts that violate these Terms or create risk for Sayspoke or other users.
6. Privacy, visibility, and recipient conduct
You are responsible for understanding the applicable visibility and relationship rules before submitting or interacting with content.
Sayspoke has distinct personal, public creator, and Community surfaces:
- Normal profile information is visible according to the profile owner’s settings and applicable relationship rules.
- Personal Moments are visible only to mutual Adds outside Communities.
- Global Finds are public creator posts.
- Communities may contain Moments and Finds under their own access rules.
- Backing Tags, Notes, replies, saves, Add relationships, creator follows, and engagement information are visible only where the relevant feature permits.
Do not submit or interact with content unless you are comfortable with the applicable audience.
If Sayspoke gives you access to another person’s nonpublic content, you agree not to misuse that access. You may not use personal Moments, private messages, private Community content, or restricted profile information to:
- Harass, threaten, or exploit another person
- Dox or expose private information
- Circumvent privacy settings
- Build unauthorized databases
- Train recognition, surveillance, or profiling systems
- Redistribute content in violation of law or another person’s rights
Privacy controls cannot prevent an authorized recipient from making a screenshot or copy.
7. User content and license
You retain ownership of content you submit to Sayspoke.
You represent that you have the rights and permissions needed to submit the content and grant the license described below.
By submitting content, you grant Sayspoke a worldwide, non-exclusive, royalty-free license to:
- Host and store the content
- Copy and process the content
- Format, resize, compress, transcode, and create previews
- Display and distribute the content to its intended Sayspoke audience
- Operate the relevant feature
- Moderate content
- Investigate reports and appeals
- Prevent fraud and abuse
- Maintain backups
- Improve Sayspoke’s content organization, safety, and recommendation systems
This license is limited by the applicable product surface:
Personal Moments
For personal Moments, the license permits Sayspoke to provide the Moment to the author and eligible mutual Adds and to operate related safety, storage, processing, and interaction features.
Sayspoke does not receive permission to use personal Moments in public advertising, public marketing, logged-out demonstrations, or public Find discovery merely because the Moment was uploaded to Sayspoke.
Global Finds
For global Finds, the license permits Sayspoke to display and distribute the Find publicly through Sayspoke, including through:
- Public feeds
- Discovery and recommendations
- Creator profiles
- Search-like surfaces
- Sharing previews
- Backing Tag collections
- Sponsored and monetized Find surfaces
Sayspoke may use public Finds to explain, market, or demonstrate Sayspoke, subject to applicable law and any controls we provide.
Community content
For Community content, the license permits Sayspoke to display and distribute the content according to that Community’s applicable access rules.
Community placement alone does not authorize Sayspoke to distribute a Community Moment as a globally discoverable Moment.
The license continues for as long as reasonably necessary to operate Sayspoke and may continue after deletion where content remains in backups, safety records, reports, legal records, or copies made by other users.
8. Content rules
You may not use Sayspoke to post, upload, share, back, promote, request, or encourage:
- Illegal activity
- Harassment, bullying, stalking, or targeted abuse
- Credible threats or incitement of violence
- Sexual exploitation or abuse
- Sexual or exploitative content involving minors
- Hate, dehumanization, or violent extremist activity
- Impersonation or deceptive identity use
- Spam, scams, fraud, phishing, or manipulation
- Malware or attempts to compromise the service
- Doxxing or sharing private information without permission
- Nonconsensual intimate content
- Content that violates intellectual-property, publicity, privacy, or other rights
- Graphic violence or gore where prohibited by Sayspoke rules
- Attempts to manipulate Backing Tags, rankings, discovery, saves, views, watch activity, advertisements, or creator revenue
- Content or conduct intended to evade moderation or enforcement
We may remove content, limit distribution, restrict features, suspend accounts, preserve evidence, or take other action when we reasonably believe content or activity violates these Terms or creates risk.
9. Backing Tags, Notes, replies, and engagement
Backing Tags are intended to communicate genuine support, context, recommendation, trust, or appreciation.
You agree not to:
- Use Backing Tags to harass, shame, threaten, or manipulate others
- Coordinate fake or deceptive Backings
- Buy, sell, or exchange Backings
- Use automation to generate Backings, views, watch time, saves, follows, Notes, replies, or other engagement
- Misrepresent your relationship with a person, creator, business, product, place, or Find
- Use Notes or replies to spam, abuse, deceive, or evade moderation
- Manipulate engagement to obtain advertising or monetization benefits
Sayspoke may rank, limit, remove, hide, invalidate, or review engagement to protect users and the integrity of the service.
10. Finds and creator content
Finds are public creator posts that may include recommendations, videos, places, products, resources, commentary, or other useful content.
If you publish Finds or manage a Finds creator profile, you are responsible for:
- Having the necessary rights to content you upload
- Accurately describing what you share
- Respecting privacy, intellectual-property, publicity, and consumer rights
- Not misleading users about sponsorships, affiliations, endorsements, prices, availability, or compensation
- Following applicable advertising, endorsement, disclosure, and consumer-protection rules
- Complying with Community rules when publishing a Community Find
- Maintaining accurate creator-profile information
If you receive compensation, free products, affiliate value, discounts, or another benefit connected to a Find, you are responsible for making any legally required disclosure clearly and prominently.
Sayspoke may label content or require additional disclosures where appropriate.
11. Advertising and creator monetization
Sayspoke may display sponsored placements or promotional content on eligible public Find surfaces.
Moments never display advertising.
Sponsored placement does not mean Sayspoke endorses an advertiser, product, service, creator, or claim.
Sayspoke may offer eligible Finds creators a monetization program. Participation may be subject to:
- Separate program terms
- Eligibility requirements
- Identity verification
- Payment thresholds
- Tax documentation
- Geographic restrictions
- Content and advertiser-safety requirements
- Fraud and invalid-traffic review
- Account standing
- Payment-provider requirements
Participation does not guarantee advertisements, revenue, minimum earnings, or continued eligibility.
Sayspoke may withhold, adjust, reverse, or refuse monetization credit associated with:
- Invalid traffic
- Manipulated engagement
- Automated activity
- Fraud
- Policy violations
- Chargebacks
- Measurement errors
- Content later found ineligible
Creators are responsible for taxes associated with money or benefits they receive.
12. Private messages
Sayspoke private messages are designed to use client-side encryption for message text.
The service may still store:
- Encrypted message content
- Participant records
- Message metadata
- Read and delivery status
- Presence signals
- Conversation state
- Key information needed to operate the feature
Do not use private messages for highly sensitive, emergency, financial, medical, legal, or confidential information.
You may not use private messages for spam, threats, harassment, fraud, scams, illegal activity, or evading moderation.
13. Communities
Communities may have their own:
- Membership requirements
- Visibility rules
- Posting permissions
- Administrator and moderator roles
- Approval requirements
- Content standards
Community owners and moderators must exercise their permissions responsibly and may not use administrative access to harass users, expose restricted information, manipulate engagement, or evade Sayspoke rules.
Sayspoke may remove Community content, restrict a Community, remove moderators, or close a Community when reasonably necessary to enforce these Terms or protect users.
Membership in a public Community does not necessarily make every post globally discoverable.
14. Reports, moderation, and safety
Sayspoke may provide reporting, blocking, appeal, and safety tools.
We may review reports and take actions including:
- Removing content
- Limiting visibility
- Restricting features
- Suspending or deleting accounts
- Restricting Communities
- Invalidating engagement or monetization
- Preserving relevant records
- Contacting affected users
- Reporting activity to authorities where legally required or reasonably appropriate
Moderation requires judgment. We are not obligated to explain every internal signal, investigation method, or enforcement decision.
15. Account deletion and content removal
You may request account deletion through available tools or by contacting us.
Deleting your account or content may not immediately remove all associated information from:
- Backups
- Logs
- Security records
- Moderation records
- Reports and appeals
- Financial and tax records
- Other users’ screenshots or copies
- Content already distributed publicly
- Records we must retain for legal, security, or operational reasons
Deleting an account does not require Sayspoke to delete content submitted independently by another person.
16. Feedback
If you voluntarily send Sayspoke feedback, ideas, bug reports, suggestions, screenshots, or comments, you allow us to use them without compensation or restriction.
This includes using feedback to:
- Improve the product
- Fix bugs
- Change features
- Build new tools
- Understand user needs
Do not include confidential information in feedback unless Sayspoke has agreed in writing to receive it confidentially.
17. Third-party services and links
Sayspoke may use third-party services for:
- Hosting
- Databases and storage
- Authentication
- Analytics
- Maps
- Media processing
- Security
- Payments
- Other operations
Those providers may process information as described in the Privacy Policy and Cookie Policy.
Sayspoke may also contain links to third-party websites, products, or services. Sayspoke does not control and is not responsible for third-party content, availability, security, policies, or practices.
18. Intellectual property
Sayspoke’s software, branding, logos, interface, original documentation, visual design, compilations, and other protectable elements are owned by Sayspoke or its licensors.
Except as permitted by law or these Terms, you may not:
- Copy or reproduce Sayspoke software
- Sell or sublicense Sayspoke
- Circumvent access controls
- Misuse Sayspoke trademarks or branding
- Create deceptive copies of the service
- Exploit Sayspoke’s nonpublic systems or materials
Nothing in these Terms transfers ownership of your user content to Sayspoke.
19. Prohibited technical activity
You may not:
- Access Sayspoke through unauthorized bots, scrapers, crawlers, or automation
- Interfere with the service or another user’s access
- Probe, scan, or test vulnerabilities without authorization
- Attempt to bypass security, privacy, age, rate-limit, advertising, or access controls
- Reverse engineer nonpublic APIs or systems except where applicable law expressly permits it
- Upload malicious code
- Collect or aggregate user data without permission
- Manipulate views, watch time, saves, follows, Backings, advertisements, or recommendations
- Use Sayspoke data to build surveillance, facial-recognition, or identity-profiling systems
- Use nonpublic Sayspoke content or data to train competing systems without authorization
- Attempt to obtain service-role, administrative, encryption-key, or other privileged access
Good-faith security research must be authorized through a Sayspoke security-reporting process or written permission.
20. No professional advice
Sayspoke content may include recommendations, opinions, places, products, videos, resources, and other user-generated material.
Sayspoke does not provide legal, medical, financial, safety, professional, or emergency advice.
Do not rely on Sayspoke as a substitute for:
- Professional judgment
- Product-safety instructions
- Emergency services
- Legal or medical advice
- Independent verification
21. Open-beta disclaimer
Sayspoke is provided in open beta and may contain:
- Bugs
- Downtime
- Data issues
- Incomplete features
- Inaccurate recommendations
- Broken uploads
- Delayed or missing notifications
- Processing failures
- Measurement errors
- Other unexpected behavior
Sayspoke may be limited by age eligibility, region, device, feature availability, signup volume, or test groups.
We may change, pause, reset, remove, or discontinue features.
You use Sayspoke at your own risk.
22. Disclaimers
Sayspoke is provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim warranties of:
- Merchantability
- Fitness for a particular purpose
- Noninfringement
- Availability
- Accuracy
- Reliability
- Security
- Uninterrupted operation
We do not guarantee that:
- Sayspoke will always be available
- Content will always remain available
- Discovery or recommendations will be accurate
- Uploaded media will always process correctly
- Every harmful user or item of content will be identified
- Users will behave honestly
- Backings or creator metrics will be accurate or fair
- Monetization will be available or profitable
- Bugs or security incidents will never occur
Privacy and access controls limit who Sayspoke permits to access content, but no technical system can prevent an authorized recipient from making or distributing a copy.
23. Limitation of liability
To the fullest extent permitted by law, Sayspoke and its owners, operators, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, creator earnings, or service access.
To the fullest extent permitted by law, Sayspoke’s total liability for claims arising out of or relating to the service will be limited to the greater of:
- The amount you paid directly to Sayspoke during the 12 months before the event giving rise to the claim
- $100
Some jurisdictions do not allow certain exclusions or limitations, so some provisions may not apply to you.
24. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Sayspoke and its owners, operators, affiliates, service providers, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of Sayspoke
- Your content
- Your Finds creator activity
- Your Community administration
- Your advertising or sponsorship disclosures
- Your violation of these Terms
- Your violation of law
- Your violation of another person’s rights
- Your misuse of Backing Tags, Finds, Moments, Notes, messages, or other features
25. Changes to these Terms
We may update these Terms as Sayspoke changes.
The updated Terms will be posted with a revised “Last updated” date. We may provide additional notice inside Sayspoke or by email when changes are material.
Updated Terms apply prospectively from their effective date unless otherwise stated.
If you do not agree to updated Terms, you must stop using Sayspoke and may request account deletion.
Your continued use of Sayspoke after updated Terms take effect constitutes acceptance to the extent permitted by law.
26. Suspension and termination
You may stop using Sayspoke at any time.
We may suspend, restrict, or terminate access if we reasonably believe that you:
- Violated these Terms
- Created safety, security, legal, or financial risk
- Harmed another person
- Manipulated advertising or monetization
- Evaded prior enforcement
- Used Sayspoke in a way that could damage the service
Where appropriate, we may provide notice or an opportunity to appeal. We may act without advance notice where immediate action is reasonably necessary.
Provisions that by their nature should survive termination remain in effect, including provisions concerning licenses, retained records, disclaimers, liability, indemnity, and disputes.
27. Governing law
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles, unless applicable law requires otherwise.
Nothing in these Terms prevents a user from receiving protections that cannot lawfully be waived under the laws that apply to them.
28. Severability and waiver
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
A failure by Sayspoke to enforce a provision is not a waiver of the right to enforce it later.
29. Entire agreement
These Terms, together with the Privacy Policy, Cookie Policy, and any additional terms that apply to a specific feature or program, form the agreement between you and Sayspoke concerning the service.
If additional terms conflict with these Terms, the additional terms control only for the feature or program they govern.
